Terms of Service

BY CLICKING THE “START TRIAL” OR “SIGN UP” BUTTON, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS (THE “AGREEMENT”) GOVERNING YOUR USE OF THE QUANTUM SERVICE.

1. Definitions

  • Company: FOP Motin Artem Serhiiovych ("Quantum", "We", "Us").
  • Service: The SaaS application for PPC automation accessible at myquantum.app.
  • You: The individual or legal entity using the Service.
  • Customer Data: Keywords, campaign data, performance metrics, and other materials you submit to the Service.

2. License Grant & Restrictions

Quantum grants you a non-exclusive, non-transferable, limited right to use the Service solely for your internal business purposes (managing PPC campaigns).

You shall not:

  • License, sell, resell, or distribute the Service to any third party (unless authorized as an Agency partner).
  • Reverse engineer or access the Service to build a competitive product.
  • Use the Service to generate fraudulent impressions or clicks on Google Ads.
  • Interfere with or disrupt the integrity or performance of the Service.

3. Account Responsibilities

You are responsible for all activity occurring under your User accounts. You must maintain the confidentiality of your passwords.

Google Ads Compliance: You represent that your use of Google Ads via Quantum complies with all Google Ads Policies. You acknowledge that Google may suspend or ban accounts for policy violations, and Quantum is not responsible for such actions.

Revocation of Access: You may revoke Quantum’s access to your Google account at any time via your Google Account permissions page.

4. Customer Data & Intellectual Property

Ownership: You own all rights to your Customer Data (keywords, ads, metrics). Quantum does not claim ownership of your advertising data.

License to Quantum: You grant Quantum a worldwide, royalty-free right to use, reproduce, and process your Customer Data solely for the purpose of providing the Service to you (e.g., generating reports, optimizing bids).

Google API Data (Ads & Merchant Center)

When you connect your Google Ads and Merchant Center accounts, Quantum accesses and processes campaign structures, keywords, ads, performance metrics, product feeds, and other data solely for the purpose of providing automation and optimization features (e.g., generating Shopping campaigns). Such data is handled in accordance with our Privacy Policy and the Google API Services User Data Policy.

No Sale of Data: Quantum does not use Google Ads data for advertising, profiling, selling user data, or for training external machine learning models.

Quantum IP: The Service itself, including its algorithms, interfaces, and code, is the exclusive property of FOP Motin Artem Serhiiovych.

5. Subscription, Payments and Delivery

  • Payment Methods: We accept payments via credit/debit cards (Visa, Mastercard) securely processed through WayForPay.
  • Service Delivery: Access to the Service (SaaS) is granted immediately after successful payment confirmation. No physical delivery is involved.
  • Billing: Services are billed in advance on a recurring basis (monthly or annually).
  • Changes: We reserve the right to modify fees with at least 30 days' prior notice.
  • Refunds: Generally non-refundable, except as explicitly provided in the Refund Policy below.

6. Refund Policy (Money Back Guarantee)

We are confident in the quality of Quantum, but we offer a transparent refund policy:

  • Monthly Subscriptions: You can request a full refund for the last paid month if you are not satisfied with the Service for any reason.
  • Annual Subscriptions: Refundable within the first 60 days of payment. After 60 days, annual subscriptions are non-refundable.
  • Cancellation: You can cancel your subscription at any time in your profile to prevent future charges.
  • Refunds: To request a refund, please contact us via the email listed in the "Contacts" section of this website.

7. Termination

We reserve the right to suspend or terminate your account if you breach these Terms (e.g., non-payment, abuse of the Service). Upon termination, your right to use the Service ceases immediately.

8. Disclaimer of Warranties (Important)

THE SERVICE IS PROVIDED "AS IS". WE MAKE NO WARRANTIES AS TO THE RELIABILITY, ACCURACY, OR COMPLETENESS OF THE SERVICE. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR THAT YOUR ADVERTISING CAMPAIGNS WILL BE PROFITABLE.

9. Limitation of Liability

Specific Disclaimer for PPC Budgets

You are solely responsible for your Google Ads budgets and spend. Quantum is an automation tool, but final control rests with you. We are not liable for:

  • Any overspending of advertising budgets (including due to API errors).
  • Loss of profits, revenue, or data.
  • Suspension of your Google Ads or Merchant Center accounts due to created campaign structures or policy violations.
  • Accuracy of product segmentation in created Shopping/PMax campaigns.

10. Governing Law

This Agreement shall be governed by the laws of Ukraine. Any disputes arising out of this Agreement shall be resolved in the courts of Ukraine.
